SALE

1. Sale and Purchase of Goods

Seyoné Retail LLC ("Seller," "we," "us," or "our") agrees to sell, and you ("Buyer," "you," or "your") agree to purchase, goods of the description and quantity shown on the checkout page ("Checkout"), incorporated here by reference ("Goods"), on the terms and conditions set forth in this Agreement.

2. Purchase Price

You agree to pay the purchase price of the Goods as posted on this website at the time of your order. All prices are listed in U.S. Dollars (USD) unless otherwise stated.

3. Payment Terms

The full purchase price is payable at the time of order, by the payment methods made available at Checkout. By submitting an order, you represent that you are authorized to use the payment method provided. If payment is not honored or is reversed, we reserve the right to cancel the order and pursue any remedies available at law, including reimbursement of reasonable costs of collection.

4. Order Acceptance

Your order is an offer to purchase. We reserve the right to accept or decline any order, or to limit quantities, for any lawful reason — including suspected fraud, pricing or product errors, or stock availability. If we cancel an order after payment, we will issue a full refund to your original payment method.

5. Delivery

Unless otherwise agreed in writing, delivery is made in accordance with our shipping policy in effect on the date of shipment. Delivery dates are estimates only. We will make reasonable efforts to meet them but are not liable for delays outside our reasonable control. Risk of loss passes to you upon delivery to the carrier. Goods are packaged according to our standard practices.

6. Sales Tax

Applicable U.S. state and local sales tax will be calculated and added at Checkout based on your shipping address and the jurisdictions in which Seyoné Retail LLC is required to collect tax. You are responsible for any such taxes shown at Checkout.

7. Limited Warranty & Limitation of Liability

We take care to describe and photograph our Goods accurately. Except as required by applicable law, and except for our obligations under our Return & Refund Policy, the Goods are provided without warranties beyond those that cannot be excluded under applicable law.

To the fullest extent permitted by law, Seyoné Retail LLC (including its members, officers, employees, agents, and affiliates, collectively the "Seller Affiliates") shall not be liable for any special, incidental, consequential, indirect, or exemplary damages arising out of or connected with the Goods or this Agreement, including lost profits or loss of data, even if advised of the possibility of such damages. In no event shall the total liability of Seller or any Seller Affiliate exceed the net purchase price of the Goods actually delivered to and paid for by you. Some U.S. states do not allow the exclusion or limitation of certain damages, so some of the above may not apply to you.

8. Color Disclaimer

Colors of products shown on your screen may vary slightly from the actual product, due to differences in monitors, screen calibration, lighting during photography, and the nature of handcrafted textiles. Such minor variations are not considered defects.

9. Handcrafted Goods

Many of our Goods are handwoven or handcrafted. Slight irregularities in weave, print, color, or finish are natural characteristics of handmade textiles, reflect their authenticity, and are not defects.

10. Force Majeure

We are not responsible for any failure or delay in performance caused by events beyond our reasonable control, including acts of God, natural disasters, fire, strikes or labor disputes, governmental action, war, terrorism, epidemic or pandemic, carrier delays, or the inability to obtain materials, labor, or supplies.

11. General

You may not assign this Agreement without our written consent. If any provision of this Agreement is found unlawful or unenforceable, the remaining provisions remain in full effect. This Agreement may not be modified except in writing by Seller; any additional or conflicting terms submitted by you are void unless we expressly agree to them in writing.
